1. Program Description

GrowlineAI, a registered DBA of Ascendry Ventures, operates the GrowlineAI Messaging Program ("Program") — a technology infrastructure that enables businesses using the GrowlineAI platform to deliver SMS and MMS messages to individuals who have affirmatively opted in. By participating in any GrowlineAI-powered messaging program, you agree to these SMS Terms of Service.

GrowlineAI is a technology platform and infrastructure provider for message delivery. The specific client business that enrolled you in a messaging program is the sender responsible for the content, legality, and compliance of the messages you receive. Message types that may be delivered through the Program include:

• Appointment reminders and scheduling confirmations
• Service notifications and account alerts
• Promotional offers and marketing messages (where express consent was separately obtained)
• Transactional and operational notifications
• Customer feedback and survey requests
• Business follow-up and lead communications

2. Consent and Opt-In

You should receive messages through the Program only if you have provided affirmative, documented opt-in consent to the specific business that enrolled you. Consent methods include checking a clearly labeled opt-in checkbox on a web form, replying to a keyword prompt, or providing consent in writing or verbally with a contemporaneous record.

Consent is specific to the program and business for which it was collected. It does not extend to other programs or businesses without your separate affirmative consent.

3. Message Frequency

Message frequency varies by program and by the client business operating the program. When you opt into a specific program, the enrolling business is responsible for disclosing approximate message frequency. Promotional programs typically send between 2 and 8 messages per month; transactional programs send messages in response to specific activity or triggers.

4. Message and Data Rates

Message and data rates may apply to messages you receive and send. These rates are set by your wireless carrier and are not controlled by GrowlineAI. GrowlineAI does not charge you directly for receiving messages. Contact your wireless provider for details about your plan's messaging rates.

5. How to Opt Out

You may opt out of the GrowlineAI Messaging Program at any time using any of the following methods:

Opt-out requests are processed within 10 business days, consistent with FCC requirements. A final confirmation message will be sent to confirm your opt-out. To re-enroll after opting out, you must submit a new affirmative opt-in request.

6. Help Instructions

Text HELP to the number that messaged you to receive support contact information. You may also email support@growlineai.com with "SMS Help" in the subject line. Our support team is available during normal business hours and will respond promptly.

7. Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages. Message delivery depends on network availability, carrier filtering, and factors outside GrowlineAI's control. GrowlineAI will make commercially reasonable efforts to ensure reliable message delivery but cannot guarantee delivery timing or completeness.

8. Privacy and Data Handling

Your phone number and opt-in consent are used exclusively to operate the messaging program you enrolled in:

• Your number is provided to telecommunications carriers and SMS aggregators solely to route and deliver your messages
• Your opt-in record is retained to document compliance with applicable law
• Your number is not used to market GrowlineAI's own products or services
• Your number is not sold, rented, or shared with any marketing list or data broker
• Your number is not shared with other businesses for their independent marketing use

9. Compliance

The GrowlineAI Messaging Program is operated in compliance with applicable requirements, including:

• The Telephone Consumer Protection Act (TCPA)
• FCC implementing regulations, including 2025 amendments
• CTIA Messaging Principles and Best Practices
• CTIA Short Code Monitoring Handbook (where applicable)
• Wireless carrier Acceptable Use Policies
• A2P 10DLC campaign registration requirements

Client businesses using the Program to send messages are independently responsible for their own regulatory compliance.

10. GrowlineAI's Reserved Rights

GrowlineAI reserves the right to modify, suspend, or discontinue any messaging program at any time for operational or compliance reasons. GrowlineAI may update these SMS Terms by posting an updated version at https://growlineai.com/sms-terms. Material changes will be communicated to active program participants. Your continued participation after the effective date of any update constitutes acceptance.

11. Governing Law and Disputes

These SMS Terms are governed by the laws of the State of Maryland and are subject to the dispute resolution and arbitration provisions in GrowlineAI's full Terms of Service at https://growlineai.com/terms.
